Amazon lost trademark infringement case filed by an Indian startup

Happy Belly Bakes prevailed in a four-year-long trademark infringement case against Amazon and its affiliated companies, Cloudtail India and Tootsie LLC.

According to Mint, the legal dispute was over the trademark of the words ‘Happy Belly.’ On August 30, a district court in Bengaluru ruled in favour of Happy Belly Bakes, ordering Amazon to remove all products bearing a similar label from its India platform. Furthermore, Cloudtail and Tootsie were barred from using the trademark in the country for the foreseeable future, and the court described their mark or logo as deceptively similar. Happy Belly Bakes is a bakery brand that began with the cofounders making custom-made chocolates. Since then, the company has grown to cover the entire Bengaluru region, employing a staff of 30 and offering products such as cookies, cakes, and other baked goods.
