The Bombay High Court has extended the restraining order against listed electrical company Polycab India, prohibiting it from selling or marketing some ceiling fans, which is a huge relief for D2C cleantech startup Atomberg.
Atomberg was granted ad interim relief on September 14 after the Bombay High Court’s Justice RI Chagla observed that Polycab had a ‘nearly identical’ visual design to one of Atomberg’s ceiling fans. “In the circumstances,” Justice Chagla observed, “an overwhelming prima facie infringement of the Plaintiff’s registered design and passing off is made out.” In response, Justice Chagla granted the D2C startup ad interim relief and scheduled the next hearing for September 26. However, the Bombay High Court rescheduled the hearing for November 21.
