According to the notification, dark patterns encompass any practice or deceptive design pattern within a platform’s user interface or user experience. These are intended to deceive or manipulate users into actions they didn’t originally intend or want to do, diminishing their autonomy or choice.
For example, ‘basket sneaking’ adds extra items during checkout without user consent, increasing the total payable amount without the user’s intention. Another dark pattern, termed as “forced action,” compels users to take additional actions, such as purchasing extra goods or divulging personal information unrelated to their original intent to buy or subscribe.
“Likewise, CCPA has specified 13 dark patterns to provide only as a guidance for the industry. Initially, CCPA had identified 10 dark patterns but after the public consultation another three were included.”
