The Delhi High Court granted Indiamart Intermesh an ex-parte injunction and barred an individual from using the trademark ‘Indiamart.’ A Sameer Samim Khan defrauded the public by posing as the company’s representative and offering them work-from-home opportunities.
Petitioner (Indiamart) has made out a prima facie case for ex parte ad interim injunction,” a bench led by Justice Pratibha Singh said. If defendant’s (Sameer Khan’s) activities are not stopped, irreparable harm will be done not only to the company, but also to the general public, who may be misled by defendant’s fraudulent activities. As a result, defendant is prohibited from using the mark / name / domain name ‘INDIAMART’ or any other mark, name, or domain name that is identical or confusingly / deceptively similar to the plaintiff’s mark ‘INDIAMART.’
