Twitter v. Musk judge says the trial is still on

Share via:

Judge Kathaleen McCormick says it’s still game on in a new letter filed with Delaware’s Court of Chancery.

Judge McCormick makes an important observation in the letter, which was sent a day after news broke that Elon Musk would seek to seal the deal with Twitter under the original terms: the trial will continue unless either party does something to formally change that. “Neither the parties nor any other party has filed a stipulation to stay this action,” Judge McCormick wrote. “As a result, I continue to press forward toward our trial, which is scheduled to begin on October 17, 2022.” The letter’s main focus is on Twitter’s concern about “allegedly inadequate production of text messages and other instant messages to and from Elon Musk.”
